CANCELED/RESCINDED SALES OF MOTOR VEHICLES

DEFINITION
A new vehicle is defined as a motor vehicle, recreational product, or specialty vehicle, the legal title to which has never been transferred by a manufacturer, distributor or dealer to an ultimate purchaser. Therefore, a sale will only be considered CANCELED when a NEW vehicle is sold, however, the incorrect Manufacturers Statement of Origin (MSO) or Certificate of Origin (CO) was submitted in error with the title file and the other vehicle is still on the lot and has not been sold.

Example: ABC Dealership received a red and a blue 2010 LL, same make and model. The MSO (or CO) for the blue LL was submitted in error with the title file for the red LL. If the blue LL is still on the dealer’s lot, the sale can be canceled on the red LL.

A used vehicle is defined as a motor vehicle, recreational product, or specialty vehicle, the legal title of which has been transferred by a manufacturer, distributor or dealer to an ultimate purchaser. Therefore, a sale can be RESCINDED when a vehicle is sold and the dealer or individual agrees to retake possession of the vehicle. A rescinded sale vehicle must be processed as a used vehicle upon reassignment of the title.

REQUIREMENTS:
All requests to cancel or rescind the sale on a motor vehicle must be directed to the Office of Motor Vehicles, Headquarters Administration, P.O. Box 64886, Baton Rouge, Louisiana, 70896-4886.

Items Required to Cancel a Sale

  • A notarized affidavit from the dealer, including a complete description of the vehicle and an explanation for the request.
  • The correct MSO/CO must be submitted with all assignments and sale/odometer information.
  • The sale will be canceled only after the correct sale has been processed.
  • If both vehicles have been sold and titled, title corrections will be processed for both vehicles.

Items Required to Process a Rescinded Sale - Individual to Individual
  • The properly assigned certificate of title reassigning the vehicle back to the original owner (including the current odometer disclosure), registration and license plate.
  • A notarized affidavit from the original owner containing a complete description of the vehicle, stating he has accepted the vehicle back and refunded the new owner his purchase price.
  • A notarized affidavit from the new owner containing a complete description of the vehicle, stating that the vehicle was returned to the original owner and that the original owner did in fact refund the purchase price. A refund request for sales tax only can be submitted at the same time.
  • $76.50 title and registration fee.
  • The appropriate license plate fee, if needed.

Items Required to Process a Rescinded Sale - Dealer to Individual
  • The certificate of title, registration and license plate.
  • The lien release, if applicable.
  • A notarized affidavit from the dealer containing a complete description of the vehicle, stating he has accepted the vehicle back and refunded the buyer his purchase price. The statement must include an explanation of why the vehicle was returned.
  • A notarized affidavit from the buyer containing a complete description of the vehicle, stating that the vehicle was returned to the dealer and that the dealer did in fact refund the purchase price and sales tax. Title, registration and license plate fees will not be refunded. Only sales tax will be refunded.
  • Option #1 - the dealer can reassign the title in his name for resale purposes only. The $76.50 title and registration fee must be submitted with the file.
  • Option #2 - the dealer can reassign the title for resale purposes only. A copy of the reassigned title must be included with the file.
